[UPDATE] Multiple Clubs Approved While Abolish ASUN Club Got Denied

ASUN is discriminating against certain clubs and individuals. As you can see from the previous post, the Abolish ASUN club was denied ASUN recognition status due to a brand new policy that was instated quite recently. However, what happened afterward is where the injustice takes place. After we were denied recognition by the commission by not emailing them 24 hours in advance due to their new policy, other clubs in the same situation: Alpha Psi Omega and Poi Club – were approved and they did not provide notice to the club commission just like us. I am not making this up. Listen below to the audio minutes posted from the club commission and pay close attention to comments from commissioners such as one who states: “don’t worry about having an absence of your advisor”. I have cropped certain sections for brevity’s sake, but the full audio minutes may be found here.

This is a compilation of multiple significant instances within the hearing with 2 second pauses. It can clearly be heard where they specifically denied us due to not notifying them that our advisor could not make it to the meeting but allowed other clubs  in the exact same situation to gain recognition.  The first section is where they denied us, then following is them approving multiple other clubs.

    Who made the decision, the Commission or the Director? This makes a difference. The ASUN law governing club recognition clearly states that “Any group of at least 10 members of the Association may petition the Director for the recognition of the Association. Recognition shall be granted based on the Club or Organization’s compliance with the [listed] terms and conditions.” SAS § 202.7(a). Implicitly this means the Director decides, but only within the bounds of the statutory terms and conditions. Further, SAS § 202.6(a) provides further evidence of the Director’s sole power to determine recognition: “The Commission will examine all petitions for Club recognition and may
    recommend to the Director
    the petitions be accepted (emphasis added). The plain language indicates any power the Commission has is advisory only. Indeed, the Commission’s agenda appears to misstate the Commission’s power by saying the Commission may veto the Director’s decisions. The Commission’s only statutory grant of power is to consider club funding requests. SAS § 202.6(b).

    Thus I see two immediate problems. First, the Department of Clubs did not properly consider this petition for recognition because it, through either the Commission or the Director, abused its statutory discretion. Second, the Department based a decision on a factor that is not among the exclusive criteria for determining whether a petitioning group qualifies for recognition.

    You can’t reach your discrimination claim until these critical procedural problems are sorted out. And, as I said earlier, your first avenue toward a remedy is to file a complaint in the Judicial Council.

    I’ll leave for another day the irony of a group seeking the recognition of an entity that the group believes has no legitimacy to exist, or, in other words, the group is seeking recognition it believes has no legitimacy.

    Also, what’s with Thornley’s comments not appearing in comment threads but are appearing on the comments tab on the blog’s sidebar? Did you guys sort of ban him from commenting?

    No, what’s happening is that we have the Disqus plugin for wordpress which means that it replaces the default wordpress plugin. What is happening with Thornley I suspect is that his computer, for whatever reason, is not properly loading up the Disqus comment system and is instead commenting on the default built-in wordpress comment system. Then, when someone who has a computer that is functioning correctly loads up the page, his comments are essentially covered up by Disqus. I’m trying to figure out how to resolve it, but it appears to only be happening to him at this point.

    Time to call those liberal crazies at the ACLU and make a stink. I think you have something that they would be very interested in and they are free. Just a suggestion.
